1. Acceptance of Terms

By accessing or using the RGHS platform, website, mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

These Terms constitute a legally binding agreement between you and RGHS Healthcare Solutions Private Limited ("RGHS", "we", "us", or "our").

If you do not agree to these Terms, you must not access or use our Services. Your continued use of the Services constitutes acceptance of any modifications to these Terms.

2. Our Services

RGHS provides comprehensive healthcare management services including but not limited to:

  • Digital health records management and secure storage
  • Online appointment scheduling with healthcare providers
  • Telemedicine consultations and virtual care services
  • Health insurance claim processing and management
  • Preventive care reminders and health tracking tools
  • Integration with empaneled hospitals and healthcare facilities

Our Services are designed to complement, not replace, traditional healthcare relationships with your healthcare providers.

3. User Eligibility

You must be at least 18 years old to create an account and use our Services independently.

Users under 18 may use the Services only with the involvement and consent of a parent or legal guardian.

You must be eligible for RGHS healthcare coverage or be a dependent of an eligible member.

You represent that you have the legal capacity to enter into this agreement and that all information provided is accurate and complete.

Corporate users must have proper authorization to bind their organization to these Terms.

4. Account Registration

To access certain features, you must create an account by providing accurate, current, and complete information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You must notify us immediately of any unauthorized use of your account or any security breaches.

We reserve the right to suspend or terminate accounts that provide false, inaccurate, or incomplete information.

Each user may maintain only one active account unless specifically authorized by RGHS.

5. Privacy & Data Protection

Your privacy is paramount to us. We are fully compliant with HIPAA, GDPR, and other applicable data protection regulations.

Personal Health Information (PHI) is encrypted using industry-standard 256-bit AES encryption and stored securely.

We implement multi-factor authentication, regular security audits, and continuous monitoring to protect your data.

You retain ownership of your health data and can request access, modification, or deletion at any time.

We will never sell, rent, or share your personal health information without your explicit consent, except as required by law.

6. Medical Disclaimers

RGHS provides healthcare management services but does not practice medicine or provide medical advice.

Our Services are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always consult with qualified healthcare professionals for medical advice, diagnosis, and treatment.

In case of medical emergencies, contact emergency services immediately - do not rely on our platform.

The information provided through our Services is for educational and informational purposes only.

We do not guarantee the accuracy, completeness, or timeliness of health information provided by third parties.

7. Billing & Payments

RGHS membership fees and service charges are billed monthly or annually as per your chosen plan.

All fees are non-refundable unless specifically stated otherwise or required by applicable law.

We reserve the right to modify our pricing with 30 days' written notice to members.

Failed payments may result in service suspension until payment is received and processed.

You are responsible for any bank charges, transaction fees, or currency conversion costs.

Cashless treatments at empaneled hospitals are subject to coverage limits and pre-authorization requirements.

8. User Conduct

You agree to use our Services only for lawful purposes and in accordance with these Terms.

Prohibited activities include but are not limited to:

  • Attempting to gain unauthorized access to our systems or other users' accounts
  • Uploading or transmitting malicious code, viruses, or harmful content
  • Impersonating others or providing false identity information
  • Using the Services for illegal activities or violating applicable laws
  • Interfering with the proper functioning of our Services
  • Harvesting or collecting user information without consent

9. Intellectual Property

All content, features, and functionality of our Services are owned by RGHS and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes.

You may not copy, modify, distribute, or create derivative works from our proprietary content without written permission.

User-generated content remains your property, but you grant us a license to use, store, and display it as necessary to provide our Services.

Trademarks, logos, and service marks displayed on our platform are our property or the property of third parties.

10. Account Termination

You may terminate your account at any time by contacting our customer support team.

We may suspend or terminate your account immediately if you violate these Terms or engage in prohibited conduct.

Upon termination, your access to the Services will cease, but these Terms will continue to apply to your prior use.

We will retain your health records as required by law and make them available to you upon request.

Termination does not relieve you of any outstanding payment obligations or liability for prior use of the Services.

11. Limitation of Liability

To the fullest extent permitted by law, RGHS shall not be liable for any indirect, incidental, special, or consequential damages.

Our total liability for any claims related to the Services shall not exceed the amount paid by you in the 12 months preceding the claim.

We do not warrant that our Services will be uninterrupted, secure, or error-free.

You acknowledge that healthcare data systems may experience technical issues and agree to maintain backup records when possible.

This limitation applies regardless of the legal theory upon which the claim is based.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India.

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in Mumbai, India.

The arbitration shall be conducted in English and follow the rules of the Indian Arbitration and Conciliation Act.

You waive any right to participate in class action lawsuits or class-wide arbitration.

If any provision of these Terms is deemed invalid, the remaining provisions shall remain in full force and effect.

13. Changes to Terms

We reserve the right to modify these Terms at any time to reflect changes in our Services, legal requirements, or business practices.

Material changes will be communicated via email, platform notifications, or prominent website notices at least 30 days before taking effect.

Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms.

If you disagree with any changes, your sole remedy is to discontinue use of the Services.

We maintain a version history of these Terms for transparency and reference purposes.
